Terms of Service

These Terms of Service (“Terms”) form a legal agreement between you (“you,” “your,” or “User”) and GalaxyGrails.io LLC, a Delaware limited liability company (“GalaxyGrails.io,” “we,” “our,” or “us”).

By accessing or using the GalaxyGrails.io website, platform, mobile applications, or services (collectively, the “Platform”), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Platform.

1. Overview of the Platform​

GalaxyGrails.io is a digital collectibles platform offering live, interactive Pokémon card pack-opening events linked to real graded cards authenticated by PSA, CGC, or BGS.

When you purchase a pack, a real graded card corresponding to that pack is revealed live and allocated to your account. Cards remain securely stored in our custodial PSA Vault account until you request shipment or choose to sell them back through our Buyback Program.

Key points:

  • All payments and withdrawals are processed through Stripe in U.S. dollars only.
  • The Platform is intended for collectors aged 18 or older residing in the United States.

2. Eligibility and Account​

To use GalaxyGrails.io, you must:

  • Be at least 18 years old and a U.S. resident;
  • Create an account with accurate and verifiable information;
  • Maintain the confidentiality of your login credentials;
  • Not share or transfer your account to another person; and
  • Comply with all applicable laws and these Terms.

You are solely responsible for any activity, transactions, or other uses made using your account, as well as for any obligations that may result from such use, including activity initiated by any third party, minor, or household member who accesses your account through your device or credentials. You are responsible for keeping your account information and password secret and confidential, and you must immediately notify us at [email protected] of any unauthorized use of your password or account or any other breach of security. We are not liable for any loss or damage arising from your failure to comply with this provision or from any unauthorized use of your account resulting from your failure to secure your credentials or devices.

We may require identity verification (e.g., through Stripe) for fraud prevention or withdrawal purposes. You must notify us immediately at [email protected] if you suspect unauthorized access to your account.

If we discover that a user is under 18 years old, we will immediately terminate their account and, where feasible, void or reverse any pending purchases. The Platform is available only in jurisdictions where its use is lawful. You are solely responsible for ensuring your participation complies with all applicable local, state, and federal laws.

3. Identity Verification (KYC)​

GalaxyGrails.io is committed to maintaining a safe and compliant marketplace. Before you can request your first shipment of any card from the Platform, you must complete our Know Your Customer ("KYC") identity verification process, powered by Stripe Identity.

When Verification Is Required​

  • First shipment request. You must successfully complete identity verification before your first shipment order can be submitted. You may browse, purchase packs, receive card reveals, use the Buyback Program, and manage your account funds without completing KYC; however, no physical card will be shipped until verification is complete.
  • Deposit threshold. Identity verification is also required when your cumulative deposits reach $500 USD. Once this threshold is reached, you must complete verification before making additional deposits or withdrawals. You may continue to use existing account funds for purchases on the Platform while verification is pending.
  • Additional verification. We reserve the right to require re-verification or additional verification at any time if we reasonably suspect fraud, unauthorized account access, a change in account ownership, or as otherwise required for legal or regulatory compliance.

Verification Process​

Identity verification is conducted through Stripe Identity, a third-party service. During the verification process, you may be asked to:

  • Provide your full legal name, date of birth, and address;
  • Upload a clear photo of a valid, government-issued photo ID (e.g., driver's license, state ID, or passport); and
  • Submit a live selfie for biometric comparison against your photo ID.

By initiating the verification process, you consent to the collection, processing, and storage of your personal information and biometric data by Stripe in accordance with Stripe's privacy policy and applicable law. GalaxyGrails.io does not directly store copies of your identity documents or biometric data; this information is processed and retained by Stripe subject to its own data-handling practices.

Verification Decisions​

  • Approved. Once your identity is verified, you may request shipments and use all Platform features without restriction (subject to these Terms).
  • Declined or Incomplete. If your verification is declined or cannot be completed, you will not be able to request shipments. You may re-attempt verification or contact [email protected] for assistance. Your cards will remain securely stored in the PSA Vault, and you may continue to use the Buyback Program or other non-shipment features.
  • Fraudulent or Misrepresented Information. Submitting false, altered, or another person's identity documents constitutes a violation of these Terms and may result in immediate account suspension or termination, forfeiture of items or funds to the extent permitted by applicable law, and referral to law enforcement.

Data Handling​

Identity verification data is processed and retained by Stripe subject to Stripe's Privacy Policy and Stripe Identity's data-handling practices. Stripe's policies govern the retention and deletion of biometric data, identity documents, and other verification information — please review them directly for current details, as they may be updated from time to time.

You may request deletion of your verification data by contacting [email protected] or by contacting Stripe directly at [email protected]. Deletion may be delayed or declined where retention is required by law.

GalaxyGrails.io receives verification results (approved/declined status and extracted personal information) from Stripe to operate the Platform. GalaxyGrails.io will not sell your identity verification data to third parties. For full details, please refer to our Privacy Policy.

4. Live Pack Events​

Each live event includes a fixed number of graded cards (usually 100–200), with one card per pack, and each pack is linked to a real graded Pokémon card.

As lower-value cards are revealed, remaining packs become “primed,” meaning the odds of pulling higher-value chase cards improve. Events automatically end when remaining expected value (EV) falls below the pack price.

New events are automatically generated when inventory allows.

Randomization and Fairness​

Card selection for each pack is determined using Chainlink VRF (Verifiable Random Function), a cryptographically secure, independently verifiable randomization system. No GalaxyGrails.io team member has prior knowledge of or intervention in the card selection process. All randomization results are recorded on-chain and are publicly auditable after each event concludes. For full technical details, see our Provably Fair guide.

Expected Value​

Cards and their estimated values are regularly updated using reputable data sources such as CardLadder to ensure that, on average over a large sample size, the estimated value of cards available in each event is designed to be substantially equivalent to or greater than the pack price. Individual results will vary — the value of any particular card you receive is not guaranteed to meet or exceed the price paid. Estimated values are point-in-time estimates only and may differ from prices achievable in any third-party marketplace.

Finality of Purchases​

Once a pack purchase is completed and the corresponding card is revealed, the transaction is final, the associated digital and custodial components are deemed delivered and accepted, and the purchase is non-refundable except as required by applicable law.

By participating in live pack events, you understand and agree that your username, pulls, and related event activity may be displayed publicly in live streams, event replays, event history pages, and fairness tools (including public fairness reports and APIs) available on GalaxyGrails.io.

5. Cards and Authenticity​

All cards on GalaxyGrails.io are:

  • Professionally graded and authenticated by PSA, CGC, or BGS;
  • Stored under GalaxyGrails.io’s custodial account in the PSA Vault (PSA, CGC, and BGS-graded cards are all stored through PSA’s vault facilities); and
  • Fully insured while in the PSA Vault under PSA’s vault insurance policies.

We do not grade cards ourselves and make no guarantees regarding third-party grading accuracy.

Vault Insurance​

Cards stored in the PSA Vault are insured by PSA against loss, damage, or destruction while in vault custody, subject to PSA’s Vault Terms and Conditions. PSA’s vault terms govern coverage limits, claims procedures, claims deadlines, and exclusions — please review them directly for current details, as they may be updated from time to time. GalaxyGrails.io will cooperate reasonably to assist you in filing a claim with PSA, but your ultimate recourse is governed by PSA’s vault terms and insurance policies.

6. Buyback Program​

After your card is revealed, you may sell it back through the Buyback Program at any time while the card remains in your account.

  • Buyback offers are typically a percentage of current market value, as disclosed on the Platform at the time of the offer, determined using reputable data sources such as CardLadder.
  • 24-Hour Price Lock. Immediately after a card is revealed, the buyback price displayed at that time is locked for 24 hours. During this window, you may accept the buyback at the locked price. After the 24-hour window expires, the buyback offer is subject to change based on current market conditions and may increase or decrease without notice.
  • Buyback values are estimates and may fluctuate based on market activity. GalaxyGrails.io determines buyback pricing in its sole discretion and makes no guarantee that a buyback offer will be available for any particular card at any particular time.
  • Once accepted, buybacks are final, and funds are instantly credited to your account.

7. Account Funds, Payments, and Withdrawals​

All financial transactions on GalaxyGrails.io are handled through Stripe, a licensed payment processor.

Account Funds Features​

Your on-platform account balance (“Account Funds”) allows you to:

  • Deposit funds via Stripe;
  • Use credits to buy packs;
  • Receive instant buyback proceeds; and
  • Withdraw funds to your Stripe-connected account.

Account Funds Limitations​

Account Funds are a closed-loop feature intended solely to facilitate transactions on the GalaxyGrails.io Platform. Account Funds are not a bank account, savings account, or general-purpose money transmission service. Funds held in your account are not FDIC-insured and will not earn interest or other returns. Account Funds may not be used for peer-to-peer transfers or any purpose other than purchasing packs or withdrawing to your linked Stripe account. All funds held in your account are maintained in pooled custodial accounts held by our third-party payment processors on your behalf; GalaxyGrails.io does not take custody of or hold title to your funds.

To withdraw funds, you must maintain a valid, active Stripe account linked to your GalaxyGrails.io account. If you do not set up or maintain a valid Stripe account, you will be unable to withdraw your funds, and your balance may become subject to applicable state escheatment laws.

Deposit Hold Policy​

As a security measure, new deposits are subject to a 7-calendar-day hold before being eligible for withdrawal. We reserve the right to impose longer holds, suspend access to deposits or withdrawals, or require additional verification where we reasonably determine such action is necessary for fraud prevention, risk management, legal compliance, or to satisfy Stripe or other third-party processor requirements.

Taxes​

Sales tax is not collected at the time of purchase for cards held in the PSA Vault, as title and possession of such items remain with the vault custodian at the time of purchase. You are solely responsible for determining, calculating, and paying all applicable sales, use, income, or other tax obligations arising from your purchase, ownership, or use of items through the Platform, including any obligations imposed by your state, local, or other applicable jurisdiction. GalaxyGrails.io does not collect, calculate, remit, or advise on taxes of any kind, and nothing in these Terms should be construed as a representation regarding your individual tax obligations. GalaxyGrails.io makes no representation that the tax treatment described herein will remain applicable in the event of future changes to applicable law, regulation, or the structure of the PSA Vault or its custodial arrangements.

IRS Reporting​

Where required by law, GalaxyGrails.io may report payments made to you (including buyback proceeds and withdrawals) to applicable tax authorities, including the IRS (e.g., via Form 1099-K). You agree to provide accurate tax identification information (including your taxpayer identification number) upon request. Failure to provide required information may result in withholding from your payouts in accordance with applicable law. Where GalaxyGrails.io is required to withhold taxes on your behalf, you authorize us to deduct such amounts from your proceeds.

Fees​

We may charge reasonable processing, service, withdrawal, or shipping fees, which will be disclosed on the Platform, at checkout, or at the time the applicable transaction is initiated. All such fees are due and payable when incurred and, except as required by applicable law, are non-refundable.

Final Sales; No Refunds​

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL PURCHASES, FEES, AND OTHER AMOUNTS PAID THROUGH OR IN CONNECTION WITH THE PLATFORM ARE FINAL AND NON-REFUNDABLE. Without limiting the foregoing, once a pack purchase is completed and/or a corresponding card is revealed, GalaxyGrails.io shall have no obligation to provide any refund, return, exchange, credit, charge reversal, or offset with respect to that transaction.

Without limiting the generality of the foregoing, no refunds, returns, exchanges, or credits will be issued for buyer's remorse, dissatisfaction with a revealed card or event outcome, changes in estimated or market value, failure to understand the nature of the product or event, failure to use purchased services or features, or suspension, restriction, or termination of your account arising from your violation of these Terms.

Except as expressly stated in these Terms or as required by applicable law, your sole remedy if you are dissatisfied with the Platform, any purchase, or any feature made available through the Platform is to discontinue use of the Platform. For clarity, nothing in this section limits any non-waivable rights you may have under applicable law, including with respect to unauthorized transactions or bona fide billing errors.

8. Storage and Shipping​

Storage​

Cards are stored in the PSA Vault, a climate-controlled, fully insured facility. For details on PSA Vault’s security, storage, and insurance, see PSA’s Vault Terms and Conditions. Cards remain under GalaxyGrails.io’s custodial account in the PSA Vault until you request shipment.

Shipping​

When you request shipment:

  • You must have completed identity verification (KYC) as described in Section 3 before your first shipment request.
  • PSA fulfills and ships directly to your verified address using insured carriers of PSA’s choosing. Shipments include PSA’s shipping insurance and require signature confirmation upon delivery.
  • GalaxyGrails.io does not provide shipping updates or select carriers; PSA handles all fulfillment logistics.

Risk of Loss​

  • While in vault storage: Cards are covered by PSA’s vault insurance as described in Section 5. Risk of loss remains with the vault custodian.
  • During shipping: Cards shipped by PSA are covered by PSA’s shipping insurance while in transit. In the event a card is lost or damaged during shipping, your recourse is governed by PSA’s insurance and claims policies as described in PSA’s Vault Terms and Conditions. GalaxyGrails.io will cooperate reasonably to assist you in filing a claim with PSA.
  • Upon delivery: You assume all risk of loss upon confirmed delivery (signature confirmation) to the address you provided.

Shipping fees vary by destination and carrier and will be disclosed before you confirm your shipment request.

9. Promotions and Giveaways​

Occasionally, GalaxyGrails.io may host promotions or sweepstakes.

  • Each event will include official rules and, where required, an Alternate Method of Entry (AMOE).
  • No purchase is necessary to enter where prohibited by law.

10. Acceptable Use Policy​

You may not:

  • Use bots, automation, or scripts to purchase packs or influence odds;
  • Engage in fraud, chargeback abuse, or money laundering;
  • Manipulate event fairness, tax obligations, or pricing;
  • Interfere with or reverse-engineer the Platform;
  • Harass other users or post unlawful content; or
  • Create multiple accounts to evade limits or bans; or
  • Create or use multiple accounts to manipulate taxable values, transfer items at artificially low prices, or otherwise circumvent tax reporting obligations.

GalaxyGrails.io reserves the right to investigate and report any suspicious activity — including patterns consistent with tax evasion, structuring, or money laundering — to the appropriate tax authorities or law enforcement agencies.

Violations may result in suspension, restriction, or termination of your account, the withholding of items or funds to the extent permitted by applicable law, and referral to payment processors or law enforcement where appropriate. For clarity, initiating a chargeback for a legitimate billing error or unauthorized transaction does not constitute chargeback abuse; abuse refers to the intentional misuse of the chargeback process to obtain money, goods, services, or credits without a valid dispute basis.

Chargebacks, Disputes, and Forfeiture​

1. Right to Dispute​

Nothing in these Terms is intended to limit any non-waivable legal right you may have to dispute an unauthorized transaction or bona fide billing error with your card issuer or payment processor.

2. Account and Item Hold​

If you initiate a chargeback, payment reversal, ACH return, or similar dispute after completing a purchase, funding your account, accepting a buyback, or completing a digital pack reveal, GalaxyGrails.io may, in its sole discretion and to the maximum extent permitted by applicable law:

  • Temporarily or permanently suspend, restrict, or terminate your account.
  • Place a hold on your account balance, withdrawals, buyback proceeds, shipments, or other account functionality.
  • Hold, withhold, delay release of, or seek recovery of any cards or items associated with your account pending final resolution.
  • Pursue reimbursement, collections, and any other remedies available at law or in equity for losses, fees, chargeback costs, and related expenses arising from the dispute.

3. Digital Goods and Custodial Allocation​

Completion of a digital pack reveal constitutes acceptance and delivery of the digital component and acceptance of the corresponding custodial allocation of the associated card.
Any dispute initiated after such completion will be treated as a dispute concerning goods and services already delivered, and the related items and account benefits may remain subject to hold, forfeiture, recovery, or denial of release pending resolution.

4. Physical Goods​

If a dispute results in a net financial loss to GalaxyGrails.io and the associated items have already been shipped, you agree that:

  • The items were received without payment.
  • You remain liable for the full amount owed in connection with those items, including their market value at the time of shipment, as reasonably determined using reputable pricing sources (e.g., CardLadder), together with applicable shipping charges and reasonable collection costs, attorneys' fees, and expenses to the extent permitted by law.
  • GalaxyGrails.io may pursue collection, recovery, and any other remedies available at law or in equity.

5. Dispute Resolution​

In evaluating whether a dispute constitutes friendly fraud, abuse of the dispute process, or an improper chargeback, GalaxyGrails.io may consider, among other things:

  • Delivery confirmation, custodial allocation, or other evidence of fulfillment of items or services (physical or digital)
  • Your acceptance of these Terms, including the final sale and no-refund provisions
  • Continued account activity related to disputed items, proceeds, or account benefits
  • Communications with you, Stripe, or other payment processors
  • Any evidence of unauthorized use, billing error, or other valid dispute basis

11. Intellectual Property​

All site content, software, logos, and media belong to GalaxyGrails.io LLC or its licensors.
You receive a limited, non-transferable license to access and use the Platform solely for its intended purpose.

You may not copy, modify, distribute, or exploit GalaxyGrails.io content without prior written permission.

12. Third-Party Services​

We rely on:

  • Stripe for payment processing and identity verification; and
  • PSA Vault for card storage and fulfillment.

Their performance, policies, and availability are beyond our control. Use of their services is governed by their own terms and privacy policies.

13. User Content and Feedback​

If you post messages or participate in live chat, you grant GalaxyGrails.io a non-exclusive, royalty-free license to display and moderate that content in connection with the Platform.
You are solely responsible for your posts. Offensive or infringing content may be removed at our discretion.

If you believe content on GalaxyGrails.io infringes your copyright, send a notice to:

Your notice must comply with the Digital Millennium Copyright Act (17 U.S.C. §512(c)(3)) requirements.

15. Disclaimers​

The Platform and all content are provided “as is” and “as available.”

We make no warranties—express or implied—regarding accuracy, uninterrupted access, market value, or that any pack will yield profit. Card values are inherently subjective, subject to change, and may be volatile. Factors outside our control—including market sentiment, collector demand, or broader economic conditions—may cause values to change suddenly without notice. Estimated values displayed on the Platform represent point-in-time estimates only and may not reflect what a card could achieve in any third-party marketplace.
Participation is for collecting and entertainment purposes only. Every pack purchase results in the delivery of a real, professionally graded trading card. It is your responsibility to determine whether your use of the Platform is lawful in your jurisdiction. We reserve the right to restrict, suspend, or terminate access from any state, territory, or jurisdiction where the Platform's features may not be permitted under applicable law, including in response to changes in legislation or regulatory guidance.

No Legal, Financial, or Tax Advice. Nothing in these Terms or on the Platform constitutes legal, financial, or tax advice. Neither GalaxyGrails.io nor any of its affiliates or staff has acted as your attorney, financial advisor, or tax advisor in connection with your use of the Platform. You are encouraged to consult your own advisors before participating.

16. Limitation of Liability​

To the maximum extent permitted by law, GalaxyGrails.io LLC and its affiliates are not liable for:

  • Any indirect, incidental, special, or consequential damages;
  • Lost profits, data, or goodwill; or
  • Claims exceeding the greater of $100 USD or the amount paid for the transaction in question.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply.

17. Indemnification​

You agree to indemnify, hold harmless, and defend GalaxyGrails.io LLC, its affiliates, and their respective directors, officers, and employees from all claims, costs, losses, damages, fees, fines, penalties, and other liabilities brought against any of the foregoing by any third party arising out of or relating to:

  • Your use or misuse of the Platform;
  • Your breach of these Terms, including any breach of representations and warranties;
  • Any violation of law or regulation or the rights of any third party; or
  • Your negligence, willful misconduct, or fraud.

GalaxyGrails.io will have the right to select its own counsel and to control the defense or settlement of any claim. This indemnification obligation expressly survives the completion of any transaction and the termination of your account in perpetuity.

18. Arbitration and Dispute Resolution​

Most concerns can be resolved by contacting [email protected].

If unresolved, disputes will be handled by binding arbitration under JAMS Streamlined Rules.

  • No class actions or jury trials permitted.
  • You may opt out within 30 days of accepting these Terms by emailing [email protected] with “Opt-Out of Arbitration” in the subject.

19. Force Majeure​

We are not liable for delays or failures caused by circumstances beyond our reasonable control, including but not limited to natural disasters, internet outages, labor disputes, government actions, or third-party service failures.

20. Termination​

We may suspend or terminate your account at any time, for any reason, including suspected fraud, legal compliance, or policy violations.

Upon termination, your right to use the Platform ceases immediately. Account funds not subject to a pending hold are immediately eligible for withdrawal. Any funds still under the 7-calendar-day deposit hold at the time of termination will become eligible for withdrawal once the hold period expires. Unclaimed account balances remaining 180 days after account termination may be subject to applicable state unclaimed property (escheatment) laws.

Business Cessation​

In the event GalaxyGrails.io ceases operations or is unable to continue providing the Platform, we will make commercially reasonable efforts to provide at least 30 days' advance notice via email to all registered users. Following such notice, you will have a period of 90 days to:

  • Withdraw your account funds to your linked Stripe account; and
  • Request shipment of any cards held in the PSA Vault under your account (subject to applicable shipping fees and completed KYC verification as described in Section 3).

Cards not claimed within the 90-day period will remain in the PSA Vault and will be handled in accordance with PSA's vault policies and applicable state unclaimed property (escheatment) laws. GalaxyGrails.io will cooperate reasonably with PSA to facilitate the transfer or return of unclaimed assets. This provision does not create any obligation for GalaxyGrails.io to continue operations and does not guarantee the availability of all Platform features during the wind-down period.

21. Updates to Terms​

We may update or modify these Terms at any time. For material changes, we will provide at least 14 days' advance notice via email or a prominent notice on the Platform before the changes take effect. Non-material changes (such as corrections or clarifications) may take effect immediately. Your continued use of the Platform after the effective date of any update constitutes your acceptance of the revised Terms. If you do not agree to an update, you must stop using the Platform before the effective date.

22. Miscellaneous​

  • Governing Law: These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles.
  • Entire Agreement: These Terms and our Privacy Policy form the full agreement between you and GalaxyGrails.io.
  • No Waiver: Failure to enforce a provision is not a waiver.
  • Severability: Invalid provisions do not affect the rest of the Terms.
  • Assignment: You may not assign rights; we may assign freely.
  • Inactivity: Accounts with no login activity for 24 consecutive months may be reviewed for closure. Any remaining eligible account balance will be handled in accordance with applicable state unclaimed property (escheatment) laws.
  • Legal Relationship: Nothing in these Terms creates an employer/employee, joint venture, fiduciary, agency, or partnership relationship between you and GalaxyGrails.io or any of its affiliates.
  • Notices: You consent to receive all notices electronically. Notices from GalaxyGrails.io to you will be sent to the email address on file and are deemed received on the day of delivery by email. Notices from you to GalaxyGrails.io must be sent to [email protected] or the mailing address listed in §23.

24. Affiliation Disclaimer​

GalaxyGrails.io is operated by GalaxyGrails.io LLC and is not affiliated with, sponsored by, or endorsed by Professional Sports Authenticator (PSA), Certified Guaranty Company (CGC), or Beckett Grading Services (BGS).
Storage and fulfillment are facilitated through PSA’s vaulting service in Delaware.

25. Affiliate Program​

GalaxyGrails.io may offer an affiliate or referral program that allows eligible users (“Affiliates”) to earn commissions or other rewards for referring new users or transactions to the Platform. Participation in any affiliate program is optional and subject to these Terms and any additional affiliate-specific terms, policies, or guidelines we publish (collectively, the “Affiliate Terms”).

Any referral signup bonus, welcome bonus, or similar promotional credit granted in connection with a referral or affiliate program is promotional only and non-transferable. Promotional credits must be used to make at least one purchase on the Platform before any account funds (including the credited amount) become eligible for withdrawal.

To participate as an Affiliate, you must be at least 18 years old, comply with all applicable laws (including advertising, consumer protection, and tax laws), and follow all Affiliate Terms we provide. Affiliates are independent contractors, not employees, partners, or agents of GalaxyGrails.io, and may not represent that they are authorized to bind GalaxyGrails.io in any way.
